
TN Visa for Canadian and Mexican Citizens
The TN Visa allows qualified Canadian and Mexican citizens to work in the U.S. in certain professional occupations under the United States-Mexico-Canada Agreement (USMCA, formerly NAFTA). Here's how the process works:
Initial Eligibility Assessment:
• Citizenship: You must be a citizen of Canada or Mexico.
• Profession Listed Under USMCA: Your occupation must be listed in the USMCA-approved professions list (e.g., accountant, engineer, scientist, pharmacist).
• Job Offer: You must have a pre-arranged full-time or part-time job offer from a U.S. employer in a qualifying profession.
• Qualifications: You must meet the specific education or credential requirements for the profession.
Gathering of Supporting Documentation:
• Proof of Citizenship: Valid passport or birth certificate.
• Offer Letter: A letter from your prospective U.S. employer describing the position, duties, duration, and your qualifications.
• Credentials: Diplomas, licenses, or degrees that verify your qualifications for the job.
• Resume and Supporting Work History: To demonstrate experience if required by the occupation.
Filing the Petition:
• Canadians: No visa is required in advance. Apply directly at a U.S. port of entry by presenting the required documentation.
• Mexicans: Must apply for a TN visa at a U.S. Embassy or Consulate before entering the U.S.
• Form I-129 (If already in the U.S.): A U.S. employer may file Form I-129 with USCIS to change or extend TN status for employees currently in the U.S.
Admission and Period of Stay:
• Approval at the Border or by USCIS: If approved, you'll be admitted in TN status for up to three years.
• Extensions: Extensions may be granted in three-year increments without a specific limit on the number of renewals.
• Dependents (TD Visa): Spouses and children may accompany the TN visa holder under TD status but cannot work.
