Humanitarian Relief Process (VAWA Visa)
The Violence Against Women Act (VAWA) allows victims of domestic violence to apply for a green card independently, without their abuser's knowledge or consent.
Initial Eligibility Assessment:
- Qualifying Relationship: Determine if you are the spouse, child, or parent of a U.S. citizen or green card holder and are a victim of abuse.
- Abuse Evidence: Assess whether you have evidence of the abuse (physical, emotional, or psychological).
Gathering of Supporting Documentation:
- Proof of Abuse: Gather police reports, medical records, or affidavits from people who witnessed the abuse.
- Relationship Evidence: Provide documents proving your relationship to the abuser, such as marriage certificates or birth certificates.
Filing the Petition:
- Form I-360: Submit Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, to apply for VAWA relief.
- Additional Forms: If eligible, you may file Form I-485 to apply for a green card once Form I-360 is approved.
Work Authorization & Decision:
- Work Authorization: VAWA applicants can apply for work authorization while their petition is pending.
- Decision: If the petition is approved, you can move forward with applying for lawful permanent residency.
