Houston E-2 Visa Attorney
A non-immigrant visa for individuals investing a substantial amount of capital in a U.S. business.
Eligibility:
- Treaty Country: Applicant must be from a country with a commerce and navigation treaty with the U.S.
- Substantial Investment: Must have made or be in the process of making a significant investment in a U.S. business.
- Control & Development: The applicant must control and develop the business.
- Job Creation: The business must be capable of generating more than just a marginal income.
Process:
- Submit Form DS-160 for visa application.
- If the applicant is already in the U.S., file Form I-129 (Petition for a Nonimmigrant Worker).
- If the applicant is abroad, apply through a U.S. embassy or consulate.
Notes:
- Spouses and children (under 21) can join on E-2 dependent visas.
- The E-2 visa is granted for 2 years but can be extended indefinitely, as long as the business remains operational.
