U Visa Process (Victims of Crime)
The U visa is for victims of certain crimes who have suffered abuse and are helping law enforcement with investigations or prosecutions.
Initial Eligibility Assessment:
- Qualifying Crime: Ensure that the crime you were a victim of is a qualifying crime, such as domestic violence, trafficking, or sexual assault.
- Law Enforcement Cooperation: Determine if you are willing and able to cooperate with law enforcement or have received a certification from them.
Gathering of Supporting Documentation:
- Crime Evidence: Gather any evidence of the crime, including police reports and affidavits.
- Law Enforcement Certification: Obtain certification from law enforcement that confirms your assistance with the investigation or prosecution.
Filing the Petition:
- Form I-918: Submit Form I-918, Petition for U Nonimmigrant Status, along with supporting documents and law enforcement certification.
Work Authorization & Green Card Application:
- Work Authorization: U visa holders are eligible for work authorization during the application process.
- Green Card Eligibility: After 3 years, you can apply for a green card if you meet certain conditions.
