E-1 Treaty Trader Visa Attorney

The E-1 visa is a non-immigrant visa for individuals or companies engaging in substantial trade between the U.S. and their home country under a qualifying treaty.

Eligibility:


Treaty Country: The applicant must be a national of a country that maintains a qualifying treaty of commerce and navigation with the U.S.
Substantial Trade: The applicant or their company must conduct substantial trade (meaning continuous, sizable, and international exchange of goods, services, or technology).
Principal Trade with the U.S.: More than 50% of the international trade must be between the U.S. and the treaty country.
Executive, Managerial, or Essential Skills Role: The applicant must be coming to the U.S. to engage in trade in a supervisory or essential capacity.

Process:

  1. Form DS-160: Complete and submit the online nonimmigrant visa application form.
  2. Form DS-156E: Treaty Trader Supplement form must also be submitted if applying at a U.S. Embassy or Consulate.
  3. Visa Interview (if abroad): Schedule and attend an interview at the U.S. Embassy or Consulate in your treaty country.
  4. Form I-129 (if already in the U.S.): If changing status from within the U.S., the employer must file Form I-129 with an E supplement.

Evidence of Substantial Trade: Contracts, invoices, shipping records, or bank statements.
Proof of Majority Trade with the U.S.: Documents showing that over 50% of trade is between the U.S. and the treaty country.
Job Description and Resume: For employees applying in an executive or essential capacity.

Validity and Renewal: 

Initial Stay: Up to 2 years granted initially.
Extensions: Unlimited two-year extensions allowed, provided trade continues.
Dependents (E-1 Visa Holders’ Family): Spouses and unmarried children under 21 can apply for E-1 dependent visas. Spouses may apply for work authorization.
