Who Qualifies for Refugee Status

Refugee status is available to individuals who are outside their home country and can’t return because of a well-founded fear of persecution. That fear must be based on one of five protected grounds: race, religion, nationality, political opinion, or membership in a particular social group. The “well-founded fear” standard requires both a subjective fear and an objective basis for it, supported by country-conditions evidence and documentation of past harm or credible future threat.

Applicants can’t self-petition for refugee status. They must be referred to USRAP by a qualifying organization, typically the United Nations High Commissioner for Refugees (UNHCR), a U.S. embassy, or another designated resettlement organization. Once referred, applicants undergo security background checks and a medical examination before any approval is granted.

Bringing Your Family Together After Resettlement

Family reunification is one of the most common reasons Houston refugees contact our firm after arriving in the United States. A principal refugee can file a Refugee/Asylee Relative Petition (Form I-730) to bring an eligible spouse or unmarried child to the country. That petition must generally be filed within two years of the principal refugee’s admission.

Refugees who have been physically present in the United States for at least one year can also apply to adjust their status to lawful permanent resident. Both family reunification and adjustment of status are core areas of our practice. We help clients understand how these steps connect and what documentation each requires.
